The Fiance Visa Processing and Wait Time


One of things that I wish we’d known when Abby, my wife (fiancee at the time) and I decided to get our K1 Fiance Visa was roughly how long the entire K1 Fiance Visa processing time would take in total, as well as the fiance visa wait time for each individual stage.  Of course, one can never predict an exact timescale for any application as it varies according to how busy the authorities are at any one time.  Plus security concerns and events such as terrorism and organized crime may occur and may lead to a slowdown in the K1 Fiance Visa processing time in some or all areas.  Note therefore that all I can give is my own personal experience and timescale.  Having said that, however, I don’t believe that my own experience was untypical.

Preliminaries

I am not going to go too much into the period before Abby and I sent in our first form, the I129 F, but obviously we spent time making sure that we met the requirements of the K1 visa (such as my wife being a US citizen and us both being in a bona fide relationship) and also collecting all the necessary evidence to send in with our I129 F and related forms.


Stage 1: The I129 F Petition

Abby sent in her I129 F Petition in March.  We weren’t prepared for the long wait time that occurs with K1 Fiance Visa processing at first and naively hoped that they would process the fiancé visa quickly.  We then got frustrated when nothing seemed to happen for a long time.  However, after just over a three month long wait, Abby received her I797, telling her that the petition had been accepted and our documents were being forwarded to the US National Visa Centre.


Stage 2: The National Visa Centre

The National Visa Centre did whatever they do with our documents then contacted the US Embassy in London, as I’m a British citizen and was living in England at the time.  About a month after Abby received her I797, the K1 Fiance Visa Application Forms were sent out to me, or rather I was told where to get them on the internet.  It took me over two weeks to gather my evidence and submit the forms.  I had already done some preparations, however, getting documents such as my Police Certificate together well in advance.


Stage 3: The K1 Fiance Visa Medical

When I received the letter about the K1 Fiance Visa, I was also informed that I needed to book my K1 medical exam and given instructions on how I should go about this.  It’s best to have it done at least 4 or 5 days before the K1 Fiance Visa, so that they have time to process the medical documents and send them on to the US Embassy in London.

Stage 4 The K1 Fiance Visa Interview

My K1 Fiance Visa interview took place towards the end of October.  I arrived at the US Embassy in London early and spent the entire morning there, not leaving until around .  Everything went well, although there was a lot of waiting around involved and you are not allowed to take any electronic devices such as mobile phones or ipods inside.  You can read a more detailed account of how my interview went here.


Stage 5: The K1 Fiance Visa was delivered by courier

My K1 Fiance Visa arrived in early November, five days after the visa interview at the US Embassy in London.  All in all, the entire K1 Fiance Visa processing time from start to finish for me had taken nearly 8 months.

I was in Florida for Christmas!

  4. Oh wow - you are the first blogger I have found who has been through what I am now going through. My fiance is also an AMerican citizen, who was living and working in the UK when we met and had been for 15yrs. Now wanting to go back home, he has taken a job in California, and me and my 2 boys are patiently waiting for our visa petition to be processed in the UK..every day is hell, my fiance and I were living together here in the UK, but he has been back in the US now since mid April, which was also when our I-129F was submitted. Rather than put eveything together ourselves, we have employed the services of Global Visa's, who have collected truck loads of info from us, including photo's of S and me, S and the kids. We have signed declarations from people we know stating that we live together and are a couple. We have submitted emails to and from each other, and flight confirmations etc etc....

    The waiting is killing me, we have a house in Cali and a house here in the UK, and I ahve jsut returned from a 2 week trip to Cali to sort out the new house and spend some much needed time with S....Somehow skype just doesn't cut it!

    Any advice you can give to us, would be gratefully received.. Reading your blog it would seem that we should be hearing something any day now really, and hopefully will get our wish and be together as a family again by Christmas.

  9. Not sure I understand the question. I attended a medical exam but I sent nothing 'medical' in. We sent in the I-129 petition, next came the K1 forms, then the medical exam, then the visa interview at the embassy.

    Unless there are good reasons why you can't, I would have thought that your boyfriend visiting you for a couple of weeks might be a good first step in furthering your relationship? Many countries have arrangements with the US whereby their citizens can visit temporarily without a visa. Or you could go to visit his country maybe? Or you could meet in a third country?

    I am awating the contact from the US consulate in London but travelling in Dec to spend xmas with fiance. Need to return to work and then leave end of Feb. Based on your timelines it seems that I may get the appointment in Nov this would mean that if all goes well the Dec trip would mean I cant return to UK (single entry). Do you know if there is a time limit for you to have medical and submit docs for app? I am hoping to delay until Jan if possible.

Dear Paul, Wouldn't it be easier for the fiancee to go to your country and marry you, return, and then go for the K3 Visa for a married couple?? and I thought I read somewhere that after 3 months they can come over and wait while things are being processed. Because I want to marry my fiancee, but we are not sure how to go about all of this K1 vs. K3 stuff!!!! thanks!

  19. Yes, that was an alternative way that we could have done it.

    My understanding is that the K3 takes longer and is more expensive, although with the K3 the non-US citizen can start working sooner (it took me months to get a Green Card after marrying with a K1).

    You need to study it in detail to decide what is best for your particular situation.

    Sometimes they change their rules and procedures too, so my info might have changed.

    My name is Tina,and my Fiance`s name is Romalice We applied for the fiance`petition on Feb.25th,on March 1st.we got our receipt of that,on June 24th we got our approval notice that our fiance`petition was approved,on Aug.8th my fiance`received his checklist from the Embassy there in his home in Bangladesh,on Sept.11th he sent in all required documents needed at that time,since that time we have been waiting for him to receive his interview,as of yet no date has been set or given him,he has sent numerous emails to the Embassy asking them when he'll get his interview and at least tell him how long it may take for that!...
    Does anyone have any idea about that??or why its taking so long a time??...Is this the normal process??..

    Please give us some information on this/Enlighten us!!..??

    so is that anything wrong that its taking long time,cause i have submitted my application on 11th September and they are sending me email that if i don't get any correspondence like 5th October,6th November and also by 28th November i have to contact with them again,means still not sure when i will get start my interview or medical exam,

  26. Quick question. I've received my packet 3 forms. Did you sign your DS-156 when you sent it off? I know you don't sign the DS-156k. Also did you attach passport photos with the forms when posting or do they do this at the embassy with your 3 photographs?

  27. @anon - I am currently writing a timeline post for the green card processing, which will give the times for when events happened for me. The process takes months, though not as long as the fiance visa, at least for me.

    @anon - It's best to check fees on the USCIS website. They keep changing.

    @Paul - I don't know what nationality you are, but for Brits, there is a pretty good write up of the process in the wiki section of britishexpats.com

  28. My fiance has filed I 129F petition for my fiance visa in Sep-2011. He recently got I 797 Notice of Action. It is attached with this email.
    Does he need to file I 824 now? There is no change in details originally provided in petition, we do not want a duplicate copy of I 797. Still does he need to file I 824 for USCSI to forward it to NVC.

  29. Thanks everyone for sharing and I'm realy glad to have found this site. Unfortunately I am facing the same dilemma and wondering if the Fiance Visa is best and why not just visit my fiance in his country and marry there. I am female in USA and he is in Sri Lanka. My plan would be to stay a month there making sure we are compatible before marrying. My concern though is that applying for his Green Card afterwards would make it a longer wait for him to move here? If someone would please weigh in ..Thanks

    2. My fiancé and I debated over getting married in his home country of England and I'm a us citizen. Our lawyer told us that the problem with filing a k3 visa or also known as getting married and filing to get citizenship here Is that yes it states that your suppose to gain entry during the process. The only problem is that it takes longer to gain entry while waiting for the process than the process it's self. K3 takes longer and means more time apart. My fiancé after sky ping our lawyer while I was visiting England we decided to go K 1 route. Even though the process from start to citizenship is longer at least it ment shorter time apart! We love each other dearly and due to my work I could not move to England during the process. We are still going through the process but I feel like we made the right decision!

    Do you have to pay a Border Security Act fee – for visa applicant included in L blanket petition, where petition indicates subject to fee (principal applicant only): $2,250.00..... or am I miss reading the dept of state website??

  35. Hi, I am waiting on my fiance's I 129 F visa to be approved. I received receipt on January 6, 2012. This waiting time seems so long. The Vermont center is processing it, but I do not know how long I have to wait, I wish they would hurry.When I call the service center all i get is a recording.

Hey I applied last year in june 23 2011 and USCIS got back to me with a denied response in dec 23 2011 then I filed a motion to reopen my case it was approved 3 weeks later right now I am waiting for my fiance to get her package from the embassy to gather her documents she needs to get her interview. so to answer your question it takes 6 months to get back to you with an answer.

  37. Waiting is really making me crazy. My Fiance filed the I 129 F peition last Oct. 27, 2011 and till now we haven't received an approval. The customer service rep at USCIS told my fiance that he will received a reply on March 28, 2012. Is it really taking this long? I've read your blog and you are so lucky that it took only 3 months for you guys to approved yours.

I live in NY (not the city) and I am going through the divorce process and believe it or not I expect the fiance visa to happen faster than my divorce papers! 7 months now and they said it would be another 6 to 8 weeks!   43. I am a british citizen from Scotland. My fiance is from California and we started off the K1 fiance visa on December 19th 2011. We received our receipt 2 weeks later but up until now we are STILL waiting on hearing back from them. We hit our 5 month mark yesterday and were under the impression that this is when we could call them up and get some information as we had became 'outwith the time frame' (as we were told to do after 4 months). Having found up though we have been told to wait another 4 weeks and if we reach 6 months we can then call them back again. The whole waiting process is so painful, i'm missing my girl like crazy! Am i right though in the understanding that this first part of the process is the longest part and once we hear from them and they send my papers onto the London Embassy, that the whole process is alot quicker?

    1. The whole thing is pretty drawn out and waiting times can vary a lot, according to their workloads, number of people applying, threats etc. It may be shorter or it may take longer... It probably won't be quick.

    I submitted the K1 petition in March of 2011, received approval in July, finally the document was sent to the embassy in Kenya. The interview was in January and they requested some documents. This process was called "Administrative process". We had to schedule a 2nd appt. to provide the requested doc. which was in March of 2012. We are now in the 2nd "Administrative process" step. The waiting is not only financially damaging but also mentally and emotionally. Any idea how long we need to wait. We would appreciate any helpful thoughts.

Since I read your post, it gave me hope that things will be like this for us, but the problem is, we already have a child which is attached in the application.     1. Sorry, but I honestly don't know. I try to stick about talking about my own experience rather than projecting myself as an expert, which I'm not. I don't have any kids, though my American wife has a daughter, so I didn't have the same situation as yourself. If you are British, you could try britishexpats.com which I always find useful.

  48. Hello. I just thought I would post about my current situation. Me and my fiance submitted our k1 on december 1st 2011. We then recieved reciept of action a couple of weeks later. Then on May 1st I got my letter from the embassy in London telling me to book my medical and send in the relevant forms, DS-156,DS-156K, DS-230 Part 1& 2 and then the proof of support and police certificate. I had my medical on June 1st whihc all went well. I am now waiting for a letter confirming when my interview date is. I have got back from Chicago today after going out for 12 days just to break up the time that we are spending apart. We also booked our wedding yesterday for September 15th. We figured that I should receive my letter any day now. I hope this just gives people a little insight into how things are going at the moment and if you have any questions regarding my petition then just ask. Good Luck to everyone! Karl

    1. I don't like putting up figures, as they can change at any time - check the official site. The main fees I paid were for the I-129 petition, the fee for the K1 visa, and the green card in the USA.

      Other major expenses were things like travelling to London for my medical and the embassy interview.

  55. Hello Paul. Thanks for the blog. I've filed my papers for my fiance since May 16th. It's now been a bit over 4 months but we haven't heard back yet. I am just wondering if you can tell me how we are supposed to hear back from them after the initial review? Will they be calling me or my fiance? Or is the best way to check is through the online status?

    1. I didn't find the online status much use, to be honest. The waiting time seems to vary a lot. 4 months is long, but not that extreme to me - a forum like the one at britishexpats.com can often give you an idea of how long they are taking to process.

  56. Hello all and thank you very much Paul for providing your experience. Just as another reference my fiancee and I submitted our petition in February 2012, we received the approval 6 months later, this from the California visa center. The approved visa petition reached the Guangzhou consulate in China two weeks later. We submitted the Ds-230 Part I and 169 this past Friday. They will not schedule the interview at the China consulate until they receive these forms. Then they notify you via the email address on the DS-230. Hope that helps.

Hi paul!my fiance his from US and im in philippines right now we meet two times already he came here in philippines,,, my fiance he aplied a K1 visa last november 2012..just worried because untill now we ddnt get some good news,we use to check through internet and still we are in desicion and my fiance he call the USCIS and ask why it take so long and they are saying it will be in end of feb and nothing happend..it hurts not being together.thanks hope to get some tips from you...

  64. Hi Paul, my fiance lives in New York and we are filing for the KI Visa. Just wanted to check are religious ceremonies allowed prior the approval of the K1 visa in the US? The religious ceremony will not be legally binding either, however not sure if this would be ok?

  65. hi everyone . my fiance lives in USA me in a country in Europe. he filled me my papers ( I-29 petition) on november and they got approved 10 days latter . now its a about 4 months we didnt get any news from them. we still on the initial phase !!! :'((( please anyone tell me what is going to happen bcuz this is so sad sad situation . :(((

    2. Yeees , it was aproved on may 16 . But no news untill now , we didnt get any letter ....How long does it takr to get thr letter of the datr of the interview ? :(

    3. Most waits as far as the visa is concerned can be measured in months rather than days or weeks, as far as my experience went. I did post a timeline of my waits, although they can vary a lot, apparently.

  66. Hello everybody!
    My fiancé filled on 24th December 2012, on 31st they sent the letter saying that was approved by USCIS, and now we`re still waiting. It`s interesting that around February we called and they said that they were reviewing the process filled in july 18th, this week again we called and they said the same thing, still reviewing 18th july 2012. How is that possible?
    Anyone else heard the same thing?
    I am Brazilian, with EU passport living in London for nearly 5 years. Do you think that it will be complicated?

  67. Hi Paul, great post mate. I am a british Citizen (Northern Ireland) engaged to an american girl and we are in the K1 process, we submitted our first documents back in November and I'm pretty sure we had everything in by xmas (I will have to check with my better half) have submitted all our documents to the NVC in Californa and I am waiting to be contacted by the London Embassey but have heard nothing yet. Can I go ahead and request my police record now? Is there an expiry on it? Is there anything else I can get a head start on? Do they designate a medical centre or can I get it done somewhere local?

    I was also wondering how they could still be working on 18 July!! lol

    1. I got my police record early as it took a month to process - there is an expiry but I forget what it is, it might be 6 months, but you'd have to check.

      They designated a specific doctor when I did it, I'd be surprised if that's changed.

  68. Is anyone still waiting? We called again today and guess what?! They`re still working on 18th july 2012. It`s the third time that we call since February and they`re still working the cases till that date. Is it only me or anyone else heard the same thing? We applied on 24th of December 2012 and since then nothing happened. :(

  69. Hi All,

    First of all thanks for this post. I have been using your info as a guide.

    I applied first week of November and we did not hear anything until the 16th of May. My Fiance in the US got a letter saying the information had gone to the US Embassy in London.

    I then got a letter on the 10th of June saying I can now apply for the K1 visa and to get the forms online and send them off ASAP.

    The police cert is valid for 12 months. and you can request duplicates up to 3 months after they issue it.

    Back to my permission to apply for K1, they have validated it for 4 months - and basically they say that is valid until completion. It may seem like a long time, but given my experience and that of those of you above, get those forms in ASAP. Also, some of the forms are now online submission only, and some of the PDF's you cannot save part completed. My advice, type your info in a word file for each form and copy and paste. that way if you have to change anything at all before you submit (or even after if you miss anything out or need to change) you dont have to re-do the forms from scratch.

    I am praying things get done for me within the next 3.5 months, i would love to get to the US before my fiance's birthday.

    1. It's difficult to say, but it was closer to the $4k for me. I paid for no legal advice. That said, the process just goes on and on. The first green card you get only lasts 2 years and so I've recently had to pay out another $600+ to get a replacement!

After being in relationship with my husband for nine years,he broke up with me, I did everything possible to bring him back but all was in vain, I wanted him back so much because of the love I have for him, I begged him with everything, I made promises but he refused.
